你院冀检〔1984〕刑字14号请示报告收悉。关于在“文革”中因参加批斗、刑讯逼供而致人伤亡的案件可否予以追诉问题，经研究，答复如下：“文革”中的案件是在特殊历史条件下发生的，对这类案件是否追诉，政策性很强，应按照中央、省委有关规定精神，报党委审批决定后，政法机关依法处理，有关部门在执行中有不同意见，亦应报请党委协调解决。
